Case study: First time hiring a foreign worker

A restaurant with many foreign customers was hiring staff, so we held an interview and received a foreign applicant. After the interview, we wanted to hire the person as a hall staff member, but we had never hired a foreign staff member before, so we were worried and the person came to consult with the administrative scrivener’s office.

Some employers may feel unsure about hiring someone for the first time.

This person has a student visa, and on the back of his residence card it says “Permission – in principle up to 28 hours per week – excluding work in the adult entertainment industry,” so he is able to work up to 28 hours per week. However, even if he has another part-time job, if it is discovered that he has worked more than 28 hours, this will be considered a “violation of permission to engage in activities other than those permitted by the status of residence permitted,” so please be aware of this when hiring.

Eligible residence statuses for hall staff

・Those with permanent residence visa, long-term resident visa, or spouse visa of a Japanese national with no restrictions on occupation
・Those with a student visa or other visa that allows them to engage in activities outside of their status of residence can be employed up to a maximum of 28 hours per week (up to 40 hours per week during long vacations).

Summary

・If an international student is working two jobs, please check in advance whether they are working two jobs or not.
・Since international students need to change their status of residence, they cannot work as hall staff after graduation. If you change your status of residence to Engineering/Specialist in Humanities/International Services, please consider transferring to a job that meets the requirements.
・If you are hiring as a chef, you can hire them if they have more than 10 years of experience as a chef in their home country.
・Be sure to submit a “Notification of Foreign Employment Status” (※ Status of Residence Link 1)
・Regarding long vacations, if you take a long vacation during the week, please calculate the number of days per day.
